These Terms & Conditions ("Terms") govern your access to and use of the Gif Pong mobile application, website, and related services (the "Service"), operated by Fusion Tech ("Gif Pong," "we," "us," or "our"). By accessing or using Gif Pong, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country to use online services, to create an account. By using Gif Pong you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. The Service

Gif Pong is a GIF-only messaging application. Users communicate by sending GIFs. AI-powered features may suggest GIF replies based on conversation context. AI suggestions may not always be accurate or appropriate.

4. Acceptable Use

You agree not to:

• Use Gif Pong to send unlawful, harassing, threatening, hateful, or sexually explicit content involving minors.
• Impersonate others or misrepresent your affiliation.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service.
• Reverse engineer, scrape, or automate access to the Service.
• Use the Service to send spam or engage in abusive behavior.
• Violate any applicable law or third-party rights.

5. User Content

GIFs and other content shared through Gif Pong may originate from third-party GIF providers. You are responsible for the content you send, including ensuring you have the necessary rights. You grant Gif Pong a limited, worldwide, royalty-free license to host, transmit, and display content solely to operate and improve the Service.

6. Third-Party GIF Providers

Gif Pong integrates with third-party GIF search and media providers. Their terms and policies apply to content sourced from them. We are not responsible for third-party content.

7. AI Features

AI-powered reply suggestions are provided "as is" and are not guaranteed to be accurate, appropriate, or fit for any purpose. You are responsible for the GIFs you choose to send.

8. Safety and Moderation

We may review reports, remove content, suspend accounts, and take other enforcement action at our discretion to protect users and the Service.

9. Termination

You may stop using Gif Pong at any time and may request account deletion. We may suspend or terminate your access if you violate these Terms or for operational, legal, or safety reasons.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Gif Pong and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data.

12. Indemnification

You agree to indemnify and hold harmless Gif Pong and its affiliates from any claims arising out of your use of the Service or your violation of these Terms.

13. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated through the app, website, or email. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Fusion Tech is established, without regard to conflict of laws principles.
